Restoration of Sanity

Penal Code section 1026.2

While an offender is subject to commitment to a state hospital after a verdict of Not Guilty by Reason of Insanity, he or she may petition the court for the restoration of his or her sanity. The offender has the burden of proving by a preponderance of the evidence that he or she will not be a danger to the health and safety of others due to a mental disorder if released to the Conditional Release Program (CONREP). If the person is released to CONREP, the release will be for a period of one year, subject to further one year extensions.
